YANG MING (UK) LIMITED Export booking Rules & notes of guidance

1.    Please check the booking confirmation sent, which details the booking made in accordance with the information provided. Should any of the details contained within the booking confirmation require amendment, please advise us immediately by email to booking@uk.yangming.com followed by a telephone call to the Booking department at Yang Ming (UK) Limited on 01708 776925 noting the name of the person you have spoken to in order to confirm safe receipt. Only upon your receipt of a revised YMUK Booking confirmation from us will your amendment or cancellation be valid.   Yang Ming (UK) Limited does not accept any responsibility for any costs and/or consequences incurred resulting from information provided verbally that is subsequently disputed from what is indicated within the booking confirmation.
2.    Customers must provide both a quote reference and a filing reference at time of booking which are valid at the time of shipment. Failure to provide either or both of these references may result in the booking request being delayed or rejected. Bookings will be invoiced in accordance with the Quote reference supplied at time of booking. If an incorrect or invalid quote reference is supplied, booking will be rated in accordance with Yang Ming's highest tariff in force at time of shipment. Yang Ming accepts no responsibility for incorrect/expired Quote References provided. 
3.    YMUK Reserves the right to charge a cancellation fee in event of any booking being reduced or cancelled after booked vessel receiving at the port of Loading has commenced. This fee also applies when a customer reduces the number of containers in a booking, transfers container(s) to a different vessel or if container(s) fail to arrive before terminal cut-off. The charge also applies to "Lost slots" in event of OOG bookings.
4.    Please note any haulage cancelled after 12 noon two working days prior to the day of loading will be subject to a wasted journey charge being applied at £400 + VAT or the full and actual cost of the journey whichever is greater. Please note that the full cost may be considerably more that the haulage rate quoted since it will not include any discount. Bookings cancelled prior to 12 Noon two working days prior to the day of collection will be considered on a case by case basis and if a charge has been incurred, this will be for the account of the booking party. Booking cancellations are to be advised by telephone immediately on 01708 776925 and confirmed in writing on e-mail to booking@uk.yangming.com  
5.    Whilst every effort will be made to position container (s) at the date & time requested, Yang Ming (UK) Ltd does not accept responsibility for any extra charges and / or liabilities howsoever arising including, but not limited to any consequential losses, as a result of unforeseen delays howsoever incurred.
6.    For all container collections, the booking time advised is considered as an advisory only of the preferred arrival time. A time of up to 60 minutes before or 90 minutes after the booked time is considered as on time.
7.    In the event that Yang Ming have given prior notice of an arrival time of more than 60 minutes before or 90 minutes after the preferred arrival time and this is accepted by the customer, then arrival within this time is considered as on time.  
8.    Free time of vehicle detention will commence from the time of arrival. In the event containers that are      en-route or have arrived in accordance with 1.1 to 1.3 above are rejected, a cancellation fee amounting to the total round trip cost or £400 whichever is greater plus container usage and lift charges will be due.
9.    Any wasted journeys, cancellation or container usage fees will be subject to VAT
10.    Containers already collected from the container yard prior to cancellation or wasted journey including any containers returned empty to our stock under merchant haulage basis, will also be subject to depot lift and container usage charges per Yang Ming tariff in force at the time of booking.
11.    The vehicle / container provided will be suitable to carry the payload declared at time of booking. Any claims, liabilities, further costs, expenses and/or fines associated with, arising from or incurred as a result (including by virtue of the denial of a defence) of, a container weight being mis-declared , will be for merchants account
12.    It is the responsibility of the merchant to ensure that the payload of the cargo loaded for export shipment does not exceed the maximum payload of the container provided and/or the limits allowed by the laws of the countries of origin and destination.
13.    3 hours are allowed to complete the loading of the container, from booked load time or arrival time of the container at the merchants premises whichever is the latter. After expiry of the 3 hours, a vehicle detention rate of GBP 60 per hour or part is applicable for the first 2 hours or part & GBP 120 per hour or part thereafter. However should the cargo not be immediately available upon arrival of the vehicle, or in Yang Ming (UK) Ltd.’s opinion the vehicle is delayed at the load point for an unreasonable period of time, then Yang Ming (UK) Ltd reserves the right to withdraw the vehicle and all costs arising from this action will be for the merchants account. These costs could be significantly higher than your quoted inland haulage.
14.    It is recommended (where required) loading references are supplied at time of booking but references must be advised at least 1 full working day prior to booked loading date & time to Yang Ming (UK) Ltd Booking dept, booking@uk.yangming.com.
In the event of late provision of a load reference (where required), a late loading reference advice charge of £90 will be applicable. This is in addition to any vehicle detention that is incurred as a result of delayed loading of the vehicle presented whilst the reference is obtained & passed on to the haulier. 
15.    All containers must arrive on quay the working day prior to vessel arrival and UCR data not advised at time of booking must be provided to the YMUK business support department on e-mail to booking@uk.yangming.com in a timely fashion in order this information may be updated in to the Port's computer system (Destin8 or CNS) linked to CHIEF prior to cargo arriving at the port in order clearance for export shipment may be obtained.
16.    It is the merchant’s responsibility to provide VGM data within sufficient time prior to the vessel VGM cut-off, this is available on request.
YM require following VGM data to be provided, failure to do so may result in additional costs for merchants account:

17.    Any containers delivered to the port of Loading prior to vessel opening date, will be subject to vessel re-nomination, location change & Demurrage charges at Yang Ming's tariff rate applicable at time of shipment. All other ports may also be subject to conditions & charges as per local practice, details available on request.
18.    In the interests of security and to satisfy the requirements of Customs Authorities in some countries, bolt seals provided by Yang Ming must be affixed to all containers. It is the Merchants responsibility to ensure that a Yang Ming bolt seal is securely affixed to the container before departure from the merchant’s premises and the seal number recorded for inclusion on the bill of lading.
Yang Ming (UK) Limited respectfully advise that failure to declare the seal number (s) on your shipping instructions will constitute Yang Ming considering the shipping instructions incomplete. A delay in documentation production will occur whilst said information is sought & moreover, a charge will be imposed of £50 per container to cover additional costs incurred obtaining said missing information.
Any claims, liabilities, further costs, expenses and/or fines associated with, arising from or incurred as a result (including by virtue of the denial of a defence) of, a container not being sealed or being sealed with anything other than a secure Yang Ming bolt seal and/or the merchant failing to record and provide the seal number in good time, shall be for the Merchants account.
Customers are also directed toward the Yang Ming Marine Transport Corp bill of lading & in particular clause 9 - 'Container packed by merchant - merchant's responsibility'.
19.    If hazardous cargo forms any part of the load, please confirm all details in writing immediately to booking@uk.yangming.com. Please allow at least 3 working days prior to loading to enable processing.

Hazardous cargo must be presented by the shipper for shipment in accordance with the IMDG code and additional regulations pertaining to the country of destination. Containers must be properly placarded & be accompanied by a signed packing certificate.

Hazardous containers delivered to the port by the merchant prior to acceptance by Yang Ming (or in the case of a chartered vessel, the relevant vessel operator), are at the merchants own risk. The Merchant accepts that carrier haulage can only be arranged once cargo is accepted by Yang Ming and/or the relevant vessel operator. Furthermore, transport arrangement may require 2 working days between time of acceptance and loading time.
20.    If out of gauge cargo forms any part of the booking, the merchant is responsible for providing accurate dimension, length, width & height, & gross weight which is to include any securing materials utilised.
21.    If refrigerated cargo forms any part of the booking, please ensure you have advised the correct temperature setting & that this is confirmed on the booking confirmation sent to you. It is also important to advise whether container vents are to be open or closed
22.    For merchant haulage bookings.
Once loaded, customer must provide on email to transport@uk.yangming.com & cc booking@uk.yangming.com, details for terminal booking according to below format.

23.    Yang Ming (U.K.) Ltd reserves the right to cancel the booking made if, in their reasonable opinion, the customer has failed to provide adequate information and / or instructions or has provided inaccurate information relating to the goods. In such circumstances any claims, liabilities, further costs, expenses and/or fines associated with, arising from or incurred as a result ( including by virtue of the denial of a defence) of, shall be for the Merchants account.
24.    Export cargo shipping instructions (bill of lading instructions) are to be provided in a timely manner prior to vessel departure by e-mail to doc@uk.yangming.com or fax to 0203 006 8853. Shipping instructions should detail the container no(s) & seal no(s) & additionally, whether required as part of the bill of lading or not, the piece count, gross cargo weight & measurement for each container.
25.    If your shipment requires OBLs, you are welcome to arrange collection of OBLs by yourselves or using your own courier service. Should you require Yang Ming to arrange postage of OBLs this will be arranged under Royal Mail Special Delivery Guaranteed by 1pm® at your own risk. Should you require cost for this please check with our sales team for details.
In the event of lost OBLs an LOI & Bank/Cash guarantee will be required prior to replacement BLs being issued, without exception.
26.    For all destinations requiring an AMS (Advanced Manifest Submission), bill of lading instructions must be submitted a minimum of 2 working days prior to vessel arrival at the port of loading. Any containers loading after this cut-off are at merchants risk and still require skeleton instructions to be submitted by the deadline with full instructions to be submitted no later than 2 Hrs after final container on consignment has been loaded. Failure to provide bill of lading instructions prior to deadline will incur late instruction fee of USD 200.00 and may also risk short shipment. Any and all charges incurred for short shipment will be for your account.
27.    Any Bills of lading requiring amendment after AMS submission will automatically incur a fee of USD 50.00 (USD 75.00 for Mexico) for each manifest amendment submitted. These include any amendments necessary due to only Skeleton instructions being initially provided.
28.    For Non AMS destinations bill of lading instructions must be submitted before vessel departure, any submitted after deadline will automatically incur late instruction fee USD 100.00.
29.    Yang Ming do not issue direct B/Ls on our Transatlantic service.   We can only issue a B/L in the name of the booking party/ freight forwarder who booked the shipment with YML. If you require actual shipper to be stated on the master B/L  (Freight forwarder C/O) we can only do so on the basis you complete a letter of indemnity, wording for which can be provided upon request. Effective August 2022 SOB Yang Ming can no longer issue a direct B/L on the Transatlantic service even with an LOI. We can only issue a B/L in the name of the booking party/ freight forwarder who booked the shipment with YML.
30.    We can file AMS for actual shipper/consignee for house bill on your behalf or if self-filing please advise shippers SCAC.
31.    To avoid any issues with US customs & border force please ensure consignee is a USA based address only.  We ask that you include the following details on your B/L instructions (if possible) to ensure prompt dispatch of NOA.

32.    Once AMS has been submitted YM do not allow filing status amendment from Auto-NVOCC to Non-Auto-NVOCC or vice versa, this is non-negotiable regardless of fines you/your Cnee may incur. 
Please ensure your shipping instructions are accurate for AMS filing purposes & adhere to the above as we will not be able to revise.
